Pop sensation Dua Lipa will face legal proceedings once more concerning her 2020 smash “Levitating”. L. Russell Brown and Sandy Linzer, songwriters of the 1979 disco tune “Wiggle and Giggle All Night,” contend that Dua Lipa borrowed “compositional elements” from their track.
US District Judge Katherine Polk Failla has mandated that the award-winning singer will proceed to court. However, the challenge for the complainants is proving beyond doubt the similarities in the melody and rhythm.
Expressing his views, the plaintiffs’ attorney, Jason Brown, mentioned, “While we respect contemporary artists, appropriate credit and compensation become pivotal if their content mirrors ours. The journey to the courtroom is something we look forward to.”
In an interesting twist, Brown and Linzer also point out that “Levitating” mirrors Miguel Bosé’s 1980 track “Don Diablo”. In a parallel development, a separate copyright case against Dua Lipa’s “Levitating” was recently thrown out, where Artikal Sound System alleged that Dua Lipa’s track closely resembled their 2017 single “Live Your Life”. Judge Sunshine Sykes, however, deemed there was insufficient evidence to prove Dua and her collaborators had prior knowledge of the song.
Moreover, Bosko Kante, a musician, recently claimed that Dua failed to secure rights to use his “talk box” in remix versions of the chartbuster. Notably, Dua has voiced in the past her surprise at the immense success of “Levitating,” sharing, “The song ‘Levitating’ was instrumental in shaping the vibe for the entire album.
